Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Maple Mindful Kids website (https://maplemindfulkids.com) and all digital products sold therein (collectively, the “Services”). By purchasing or downloading any product, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to create an account or make a purchase. By using our Services you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.
2. Digital Products and Licence
What you receive
Upon purchase, Maple Mindful Kids grants you a personal, non-exclusive, non-transferable, revocable licence to download and use the purchased digital files for personal and educational purposes in accordance with these Terms.
Permitted uses
- •Printing files for your own household, classroom (as the purchasing educator), or therapy practice (as the purchasing therapist/counsellor).
- •Displaying digital files on personal devices.
- •For design packs (SVG + PNG): creating personal print-on-demand items (e.g., custom shirts, mugs, tote bags) as gifts for individuals. Personal use only — not for commercial resale.
Prohibited uses
- •Reselling, sublicensing, or distributing digital files to others in any format.
- •Sharing file download links with anyone who did not purchase the product.
- •Uploading files to any platform, repository, or marketplace for redistribution.
- •Using any Maple Mindful Kids content to create competing products or services.
- •Removing or altering copyright notices, watermarks, or attribution within files.
- •Commercial printing or production for resale purposes.
Violation of these licence terms will result in immediate termination of your licence and may result in legal action.
3. Pricing and Payment
All prices are displayed in Canadian dollars (CAD) unless otherwise indicated. We accept payment via Stripe (Visa, Mastercard, American Express, Apple Pay, Google Pay) and PayPal. All transactions are processed securely by our payment processors — we do not store card details.
Applicable taxes (GST/HST for Canada, VAT for EU/UK, state sales tax for applicable US states) are calculated and collected automatically using Stripe Tax. The final price including applicable taxes is displayed at checkout before you complete your purchase.
4. Refund Policy
Please refer to our separate Refund Policy for full details. In summary: digital downloads are non-refundable once delivered, except in cases of technical defect or accidental duplicate purchase.
5. Download Links and Access
Download links are sent by email and are valid for 48 hours. Registered account holders can regenerate download links at any time from My Account → Orders. Guest purchasers who need new links should contact us at contact@maplemindfulkids.com.
6. Intellectual Property
All content on the Maple Mindful Kids website — including text, graphics, illustrations, audio, video, digital products, and the Maple Mindful Kids and DailyWins trademarks and logos — is the exclusive property of Maple Mindful Kids and its licensors, protected by Canadian and international copyright law. The tagline Nurture & Grow™ is a registered trademark. Unauthorised reproduction or use is prohibited.
7. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@maplemindfulkids.com if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.
8. DailyWins App
Use of the DailyWins mobile application is also subject to the in-app Terms of Service and the separate DailyWins Privacy Policy. In the event of conflict between these Terms and DailyWins-specific terms, the DailyWins-specific terms shall prevail for app use.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses. Our digital resources are intended to support emotional learning and wellbeing — they are not a substitute for professional medical, psychological, or therapeutic advice.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Maple Mindful Kids shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any dispute shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by email to registered users and by updating the “Last updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
